Terms & Conditions – BuddyCal (EN)

By downloading, accessing, or using the BuddyCal app (the “App” or “Service”), you agree to these Terms & Conditions. If you do not agree, please stop using the App.

1. Acceptance of Terms

   By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Minimum Age

   You must be at least 13 years old to use the Service.

   If you are between 13–17 years old, you represent that you have consent from a parent/legal guardian as required by applicable law.

   We may suspend or terminate access if we learn that a user does not meet the age requirement.

3. Scope of Service and Health Disclaimer (Not Medical Advice)

   BuddyCal provides calorie tracking, meal planning, and nutrition-related information for general informational purposes only.

   The Service is not medical diagnosis, treatment, or professional medical advice.

   Consult a qualified professional before changing diet/exercise plans, especially with underlying conditions, pregnancy, or other risk factors.

4. Account and Security

   You may need to create an account to access parts of the Service.

   You are responsible for keeping your account information accurate and maintaining the confidentiality of your login credentials.

   Notify us promptly if you suspect unauthorized access to your account.

5. Personal Data and Privacy

   Our processing of your personal data is governed by our Privacy Policy.

   We may collect and process data such as email, photos, age, weight, and health/nutrition-related information to provide and improve the Service.

6. Prohibited Conduct

   You agree not to:

   • Use the Service for unlawful purposes or in violation of these Terms.
   • Attempt to hack, disrupt, reverse engineer, or bypass security measures.
   • Use the Service in a way that harms us, other users, or third parties.

7. Fees

   The Service is currently free of charge. We may introduce paid features in the future and will provide notice as appropriate.

8. Intellectual Property

   The App, software, content, design, trademarks, and all elements of the Service are owned by us (or our licensors). You are granted a limited, revocable, non-transferable license to use the Service in accordance with these Terms.

9. Third-Party Services

   The Service may rely on or link to third-party services. Your use may also be subject to those third parties’ terms/policies. We are not responsible for third-party services outside our control.

10. Disclaimer

    The Service is provided “as is” and “as available”. We do not warrant that the Service will be accurate, complete, error-free, or uninterrupted.

11. Limitation of Liability

    To the maximum extent permitted by law, we will not be liable for indirect, special, consequential, or punitive damages arising out of or related to your use of the Service.

12. Suspension and Termination

    We may suspend or terminate your access if we reasonably determine that you violated these Terms or your use poses a risk to the security of the Service.

13. Changes to These Terms

    We may update these Terms from time to time. Continued use after the effective date constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

    These Terms are governed by the laws of Thailand, and Thai courts will have jurisdiction unless applicable law provides otherwise.
