1. Acceptance of Terms

By downloading, installing, accessing, or using the Service, you agree to these Terms and our Privacy Policy, which is incorporated by reference.

2. Eligibility and Minimum Age

You must be at least 13 years old to use the Service. If you are between 13–17, you represent that you have parental or guardian consent as required by applicable law.

We may suspend or terminate access if we learn that a user does not meet the age requirement.

3. Scope of Service and Health Disclaimer

BuddyCal provides calorie estimation from food photos, step tracking, health goal monitoring, and general nutrition information for personal wellness purposes only.

The Service is not medical advice. It is not a diagnosis, treatment, or substitute for professional care. Calorie estimates from photos are approximations and may contain errors.

Consult a qualified professional before changing your diet or exercise plan, especially if you have underlying conditions, are pregnant, nursing, or have other health risks.

In a medical emergency, contact emergency services immediately.

4. Account and Security

You may need to create an account to access certain features. You are responsible for keeping your account information accurate and your login credentials confidential.

Notify us promptly at support@calbuddy.live if you suspect unauthorized access to your account.

5. Personal Data and Privacy

Our collection, use, and disclosure of your personal data is governed by our Privacy Policy, which describes the types of data we collect, purposes, your rights, and security measures.

6. User Content

When you upload meal photos, profile images, or other data through the Service (“User Content”), you retain ownership of that content.

You grant us a license to use, store, process, and display User Content as necessary to provide the Service, improve calorie estimation accuracy, and comply with law.

You represent that your User Content does not infringe third-party rights, is not unlawful, and does not contain inappropriate material.

7. Prohibited Conduct

You agree not to:

• Use the Service for unlawful purposes or in violation of these Terms.
• Attempt to hack, disrupt, reverse engineer, or bypass security measures.
• Use bots, scripts, or automated tools to access the Service without authorization.
• Upload harmful, obscene, or rights-infringing content.
• Use the Service in a way that harms us, other users, or third parties.

8. Fees and Subscriptions

Core features of the Service may be available free of charge. We may offer premium features or paid subscriptions in the future.

If subscriptions are offered, billing, renewal, and cancellation terms are governed by our Subscription Terms and applicable App Store terms.

9. Intellectual Property

The app, software, content, design, trademarks, and all elements of the Service are owned by us or our licensors. You are granted a limited, revocable, non-transferable license to use the Service in accordance with these Terms.

10. Third-Party Services

The Service may integrate with third-party services such as the Apple App Store, Supabase, or analytics providers. Your use may also be subject to those third parties’ terms and policies.

We are not responsible for third-party services, content, or policies outside our control.

11. Disclaimer

The Service is provided “as is” and “as available.” We do not warrant that the Service will be accurate, complete, error-free, or uninterrupted.

Results from calorie estimation, step tracking, or nutrition data may vary by individual and depend on the information you provide and your usage environment.

12. Limitation of Liability

To the maximum extent permitted by law:

• We will not be liable for indirect, special, consequential, or punitive damages arising from or related to your use of the Service.
• Our total liability will not exceed the amount you paid us in the 12 months before the event, or USD 100, whichever is less.
• Nothing in these Terms limits liability where prohibited by applicable law.

13. Suspension and Termination

We may suspend or terminate your access if we reasonably determine that you violated these Terms or your use poses a security risk.

You may stop using the Service at any time by deleting the app and/or requesting account deletion as described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you via the app, website, or other appropriate means. Continued use after the effective date constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Thailand, and Thai courts will have jurisdiction unless applicable law provides otherwise.
